Terms of use
Last updated 2026. These terms cover use of gearnest.lk by buyers, sellers, renters and dealers in Sri Lanka.
Not legal advice. This is a first draft using standard classifieds-industry language. It should be reviewed by a qualified Sri Lankan lawyer before being treated as final or binding.
1. Gear Nest is a listing platform only
Gear Nest provides an online classifieds service where sellers publish vehicle, rental and parts listings and buyers browse them. We are a neutral venue. We are not a dealer, broker, agent, auctioneer, importer, valuer or insurer.
We are not a party to any transaction. Any sale, rental, deposit, exchange or agreement is solely between the buyer and the seller. They alone are responsible for negotiating terms, verifying each other's identity, transferring ownership, paying taxes and duties, and settling any dispute that arises.
2. We do not own, hold or inspect vehicles
Gear Nest never takes possession or ownership of any vehicle, machine or part listed on the platform. We do not physically inspect vehicles, test drive them, check odometers, confirm registration or ownership documents, or assess roadworthiness.
3. We do not verify seller claims
Listing content — price, year, mileage, condition, accident and service history, drive options, deposits, photos and contact details — is supplied by the seller. Gear Nest does not verify its accuracy or completeness, and a "Verified" badge refers only to limited account checks, never to the vehicle itself.
Buyers must carry out their own inspection and due diligence before paying any money: meet in person, inspect the vehicle, confirm the registration book and ownership match the seller, and never pay a deposit in advance to someone you have not met.
4. No liability for disputes or losses
To the fullest extent permitted by law, Gear Nest is not liable for any loss, damage, cost, fraud, misrepresentation, injury or dispute arising from a listing, a communication between users, or any transaction — including failed payments, undisclosed defects, stolen or encumbered vehicles, and rental damage or deposit disputes.
Buyers and sellers bear full responsibility for their own transactions and for complying with Sri Lankan law, including registration transfer and any applicable revenue licence, insurance and emissions requirements.
5. Service provided "AS IS"
The platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of listings, uninterrupted availability, or freedom from errors. We may change, suspend, moderate, reject or remove any listing or account at our discretion.
6. Content licence
By submitting a listing you confirm you own the content or have the right to use it, and you grant Gear Nest a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, watermark, adapt and display that content — including photos and descriptions — on the platform, in search results, in sitemaps and social previews, and in marketing of the platform. You may withdraw a listing at any time; cached and third-party copies may persist beyond removal.
You must not upload content you do not have rights to, misleading or duplicate listings, stolen vehicles, or another person's contact details.
7. Prohibited use
No scraping, bulk data extraction, reselling of listing data, spam, fraud, money requests before viewing, or attempts to move users off-platform for deceptive purposes. Accounts involved in scams may be suspended without notice.
